Background:
Our trademark application was abandoned after a Section 2(d) Likelihood of Confusion refusal was issued by the USPTO. The application lapsed due to a failure to respond to the Office Action by the deadline. We need to act immediately as the window to file a Petition to Revive is time-sensitive.
Scope of Work:
Part 1 – Petition to Revive (Immediate Priority)
Prepare and file a Petition to Revive Abandoned Application with the USPTO via TEAS
Draft the required signed declaration stating the delay was unintentional
Advise on and handle all associated USPTO filing fees
Ensure the petition is filed well within the two-month revival window
Part 2 – Response to Section 2(d) Likelihood of Confusion Refusal
Review the full Office Action and the cited conflicting mark (to be shared privately)
Develop a legal strategy to argue against the refusal
Draft and file a complete, persuasive response to the Office Action
Advise on the likelihood of success and present any alternative strategies if needed (e.g., consent agreement, coexistence agreement, or amending the identification of goods)
Requirements:
Licensed U.S. attorney in good standing with active USPTO trademark prosecution experience
Demonstrated experience handling Petitions to Revive abandoned trademark applications
Demonstrated experience responding to Section 2(d) Likelihood of Confusion refusals
Familiarity with TEAS and USPTO filing procedures
Ability to start immediately — this is time-sensitive
Strong communication and responsiveness throughout the engagement
